1. Acceptance of Terms

By accessing and using A3ART ("the Platform"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Platform.

2. Description of Service

A3ART is a decentralized NFT marketplace built on the A3Chain blockchain. The Platform allows users to:

• Create, buy, sell, and trade Non-Fungible Tokens (NFTs)
• Create and manage NFT collections
• Connect with artists and collectors
• Participate in the digital art community

3. User Accounts and Wallets

3.1 Wallet Connection

To use the Platform, you must connect a compatible Web3 wallet (MetaMask or Polkadot.js). You are responsible for:

• Maintaining the security of your wallet and private keys
• All activities that occur under your wallet address
• Any losses resulting from unauthorized access to your wallet

3.2 Account Responsibilities

You agree to provide accurate, current, and complete information and to update such information to keep it accurate, current, and complete.

4. NFT Transactions

4.1 Blockchain Transactions

All NFT transactions are conducted on the A3Chain blockchain and are irreversible. Once a transaction is confirmed on the blockchain, it cannot be undone.

4.2 Gas Fees

Users are responsible for paying all gas fees associated with blockchain transactions. Gas fees are non-refundable.

4.3 Smart Contracts

NFT transactions are executed through smart contracts. While we strive to ensure the security and reliability of our smart contracts, we cannot guarantee they are free from bugs or vulnerabilities.

5. Intellectual Property

5.1 User Content

When you create or upload NFTs, you retain ownership of your intellectual property rights. However, you grant A3ART a worldwide, non-exclusive, royalty-free license to display, reproduce, and distribute your content on the Platform.

5.2 Copyright Compliance

You represent and warrant that you own or have the necessary rights to all content you upload. You must not upload content that infringes on the intellectual property rights of others.

5.3 DMCA Policy

We respect intellectual property rights and will respond to valid DMCA takedown notices. If you believe your work has been infringed, please contact us at dmca@a3art.io.

6. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Violating any laws or regulations
• Infringing on intellectual property rights
• Uploading malicious code or viruses
• Manipulating prices or engaging in wash trading
• Creating fake or misleading NFTs
• Harassing or threatening other users
• Attempting to gain unauthorized access to the Platform
• Using bots or automated tools without permission

7. Fees and Payments

7.1 Platform Fees

A3ART charges a 2.5% fee on all NFT sales. This fee is automatically deducted from the sale price.

7.2 Creator Royalties

Creators can set royalty percentages (0-10%) on their NFTs. Royalties are automatically paid to creators on secondary sales.

7.3 Payment Processing

All payments are processed in A3C tokens on the A3Chain blockchain. We do not handle fiat currency transactions.

8. Disclaimers and Limitations of Liability

8.1 "As Is" Service

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied.

8.2 No Investment Advice

Nothing on the Platform constitutes investment, financial, legal, or tax advice. You should consult with professionals before making any investment decisions.

8.3 Limitation of Liability

To the maximum extent permitted by law, A3ART shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

9. Indemnification

You agree to indemnify, defend, and hold harmless A3ART and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any rights of another party
• Your content uploaded to the Platform

10. Termination

We reserve the right to suspend or terminate your access to the Platform at any time, with or without cause, with or without notice. Upon termination, your right to use the Platform will immediately cease.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting a notice on the Platform. Your continued use of the Platform after such modifications constitutes your acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which A3ART operates, without regard to its conflict of law provisions.

13. Dispute Resolution

Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration, except where prohibited by law.
